1. Artwork and intellectual property
The designs sold in this store are created by independent artists, who own their artwork and license it to us under our Artist Terms. Each artist promises us that they made their artwork, or have the rights to all of it, and that it doesn't infringe anyone else's rights. Artists accept full responsibility for their artwork and agree to defend and indemnify us against any claim arising from it.
The store itself, including its design, text, logos, the library card design and our serial number system, belongs to Windowmeme LLC. Nothing on this site may be copied, reproduced or used commercially without our written permission or, for artwork, the artist's.
2. How we screen for copyrighted material
We use an automated AI filter to screen uploaded artwork for material that may belong to someone else, such as known characters, logos, brand names and existing artworks. The filter is an attempt to catch problems early, not a guarantee. It can miss things, and it can flag things that are fine. Passing the filter does not mean a design is free of third-party rights, and we don't promise that every design on this site is. If you see something that shouldn't be here, please tell us (section 3).
3. Reporting copyright or trademark infringement
If you believe a sticker on this site infringes your copyright or trademark, email copyright@vancouverstickercompany.com or write to the mailing address above. Please include:
- your name, mailing address, phone number and email address;
- a description of the work or mark you believe is being infringed;
- a link to each sticker you're reporting;
- a statement that you have a good-faith belief the use isn't authorized by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner, or are authorized to act for the owner;
- your physical or electronic signature.
We review every report. We may remove or disable a sticker while we look into it, and we'll let the artist know. Submitting a knowingly false report may make you liable for damages.
4. Counter-notices
If your sticker was removed and you believe that was a mistake, email copyright@vancouverstickercompany.com with: your name, address, phone number and email; a link to or description of the removed sticker; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; your consent to the jurisdiction of the federal court for your district (or, if you're outside the United States, any district where we can be found) and to accept service from the person who reported it; and your signature. We may restore the sticker unless the person who reported it tells us they've filed a court action.
5. Repeat infringers
We remove artists who repeatedly infringe other people's rights, and we may withhold their royalties as set out in our Artist Terms.
6. No warranties
This site, its content and its products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise the site will be uninterrupted, error-free or free of harmful components, or that any content on it is accurate or complete.
7. Limitation of liability
To the fullest extent the law allows, Windowmeme LLC and its owners, employees, artists, contractors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of this site or its products, even if we were told such damages were possible. Our total liability for any claim is limited to the amount you paid us for the order the claim is about, or $25.00 if the claim isn't about an order. Some places don't allow these limits, so some of them may not apply to you.
8. Your indemnity to us
To the fullest extent the law allows, you agree to defend, indemnify and hold harmless Windowmeme LLC and its owners, employees, artists, contractors and service providers from any claim, demand, loss, damage, fine, penalty, settlement, cost or legal fee arising from: your use or misuse of this site or its products; anything you submit to us; your breach of this notice, our Terms of Service or any of our policies; or your violation of any law or anyone else's rights. We may take control of the defense of any such claim, and you agree to cooperate with us.
9. Third-party links and services
This site links to and relies on services we don't control, including Shopify, payment processors and shipping carriers. We aren't responsible for their content, policies or performance.
10. Governing law
This notice is governed by the laws of the State of Washington. Any dispute goes to the state or federal courts in Clark County, Washington.
11. Changes
